Focus Forward, LLC (“Focus Forward,” “we,” or “us”) is excited that you are interested in our market research opportunities. Our goal is to provide our members with an easy way to earn extra cash and use their opinion to shape the products and/or services of our clients. This Terms of Use agreement (“TOU” or “Agreement”) sets forth the terms, conditions and guidelines for your participation in our online surveys and your use of the FF Focus Group (www.surveysquad.com) and Focus Forward (www.focusfwd.com) web sites (collectively, the “Site”). This TOU constitutes a legally binding contract between the user (“you”) and Focus Forward which you must read and agree, in order to complete the registration process. By clicking the “I Accept” button at the end of this Agreement, you signify your agreement to this TOU.

1. CHANGES TO THIS DOCUMENT

ATTENTION ALL MEMBERS – PLEASE NOTE THAT THERE HAS BEEN A SIGNIFICANT CHANGE TO THE FOCUS FORWARD TERMS OF USE REGARDING THE ADDITION OF THE FOCUS FORWARD MONTHLY SWEEPSTAKES. THERE IS NO PURCHASE NECESSARY TO ENTER OR WIN. WINNERS WILL BE ANNOUNCED ON OUR WINNERS PAGE APPROXIMATELY SEVEN (7) DAYS AFTER THE DRAWING DATE. PLEASE SEE OUR COMPLETE OFFICIAL RULES.
We may continue to occasionally update this TOU. When we do, we will also revise the “last modified” date at the top of this TOU so you know the Agreement has changed. For material changes to this TOU, we will notify you either by placing a prominent notice on the Member page of our Site or by directly sending you a notification. We encourage you to periodically review this TOU to stay informed about our Site policies and procedures. Your continued use of this Site constitutes your agreement to this TOU and any updates thereto.

2. ONLINE SURVEYS vs. TRADITIONAL RESEARCH

Online Surveys allow members to participate in some type of research and the members are offered points that can be converted into rewards. Upon completion of your enrollment survey, you may from time to time be asked to complete a profile enhancer to build your profile and earn points for rewards.

Traditional Research, in contrast, Traditional Research requires members to make themselves available for live in-person focus groups, moderated online bulletin boards, online focus groups, telephone interviews and including, but not limited, to product tests and many other types of projects.

3. HOW TO REGISTER

To register for membership with Focus Forward, you must provide all required information in our enrollment survey.

Only one Member account per person and per email address may be submitted. Original account and any subsequent accounts established by a person using the same or different email account addresses may be void, at Focus Forward’s discretion. Members may be required to show proof, to Focus Forward’s satisfaction, of being the authorized email account holder. Focus Forward reserves the right to terminate all accounts for any person found to have more than one account and void all associated points for rewards, and/or sweepstakes entries and/or any and all types of incentive. After completing the initial required enrollment survey you will receive an email confirming your desire to join our panel. By clicking on the link in this e-mail, you will complete the registration process and become a member of Focus Forward and FF Focus Group. You will also be considered a member of Focus Forward and FF Focus Group upon participation in any Online Study or Offline Focus Group, even if the registration confirmation is not completed as indicated above.

4. CONDITIONS

Your eligibility to participate in Online Surveys or Traditional Research will vary depending on the requirements and objectives provided by Focus Forward’s clientele. Focus Forward will review the information provided by its members during the enrollment process to select those members who meet the criteria and/or profile required for the specific survey it is conducting. For example, a survey may require participants who are of a specific age, income, profession, or culture. If you do not fall into the specific category of individuals required by the survey, you will not be selected to participate. You hereby understand and agree that Focus Forward has no obligation to provide you with survey opportunities or to allow you to participate in any study, focus group or survey.

5. CHILDREN

This Site is not intended for or directed to persons under the age of 13. By clicking “I Accept” at the end of this TOU, you represent and warrant to Focus Forward that you are 13 years of age or older. It is our policy to endorse the Children’s Online Privacy Protection Act of 1998 and to use our best efforts to comply with that Act.

6. EMAILS

By agreeing to this TOU and registering with Focus Forward, you agree to receive e-mails from Focus Forward and FF Focus Group inviting you to participate in or providing you with information about Online Surveys and/or Traditional Research. You don’t have to participate in every instance. If, at any time, you decide that you don’t want to participate in our market research opportunities at all, you can unsubscribe by clicking on the “UNSUBSCRIBE” link in any e-mail you receive from Focus Forward.

7. REFERRALS AND ANTI-SPAM POLICY

Focus Forward encourages you to spread the word about membership with Focus Forward to any of your family members or friends who you think may be interested. We have therefore prepared a standard email which is available on our Member page that you can use to invite your friends and family to enroll as members of Focus Forward. Focus Forward prohibits the use of this email referral service for any transmission, distribution or delivery of (i) unsolicited emails to any person or (ii) an email to an individual with whom you do not have a personal and close relationship with (“Spam”).You hereby agree that you will not use the referral email on this Site to send Spam to anyone. If you Spam any individual in order to generate referrals, you will be ineligible for any payments from Focus Forward and will be permanently disqualified from participation in future surveys and/or offline focus groups with Focus Forward. Focus Forward will not intentionally Spam you. If you encounter potential Spam activity from a member of Focus Forward, please contact us immediately at help@focusfwd.com.

8. TERMINATION OF MEMBERSHIP

Focus Forward shall have the right to immediately terminate your membership and cease payment to you for all surveys completed under your user name if it determines that: (i) you have abused, altered, or otherwise misused this Site; (ii) you have provided Focus Forward/FF Focus Group with any false information about yourself; (iii) you have not completed all surveys truthfully and accurately; (iv) you have failed to safeguard your user name and password; or (v) have allowed a third party to use your unique user name and password to complete any survey on your behalf.

If you wish to terminate your membership with Focus Forward at any time, you may do so by (i) logging into your Focus Forward/FF Focus Group account, select the “Members” tab and clicking “My Account” and entering your password in the “Unsubscribe” field at the bottom of the page OR (ii) sending an email to priorityhelp@focusfwd.comclearly stating your intent to terminate your membership.

9. PAYMENT

ONLINE SURVEYS and TRADITIONAL RESEARCH. Members are responsible for all taxes due as a result of payments they receive from Focus Forward for participation in surveys or referrals, or both. Focus Forward is required by law to issue an IRS form 1099 to any member paid $600.00 or more annually for participation in surveys or referrals, or both. All members agree, when requested by Focus Forward, to provide Focus Forward with all information necessary for Focus Forward to comply with all tax reporting requirements.

ONLINE SURVEYS. Points and/or entries in our monthly sweepstakes are provided for full participation in most online surveys. Payments and sweepstakes entries for completing or terminating surveys are only made if the member is in good standing and the information in the survey is authenticate, relevant to the study and meets any criteria established by Focus Forward/FF Focus Group for the survey applicants. As part of the membership process, you permit us to contact you to validate your participation and the accuracy of your responses. You must complete the incentive request process in the Member section of this Site to receive a payout of the amounts you have earned. Please note that in order to request a payment, you must have a minimum balance of 20,000 points existing in your online account. All members must request conversion and payment of incentive credits within 12 months after the date their online account first reaches or exceeds a balance of 20,000 points or such incentive credit and any right to conversion and payment shall be forfeited. If a Member does not participate during a four (4) month period, Focus Forward may elect, in its sole discretion, to terminate his/her membership without notice. For each 20,000 point prize claim, a maximum of 10,000 points can have been earned from referral awards, with the remainder needing to be earned from survey participation. Focus Forward is not responsible for delays in reporting cash credit or your failure to receive any cash payment.

TRADITIONAL RESEARCH Incentives are provided for full participation in most of Focus Forward’s research projects. Compensation will be paid upon the full completion of the live interview or focus group. If you are participating in Traditional Research of any kind, you will receive payment at the address you provided when being offered the project. Incentives from Traditional Research will always be paid separately from Online Surveys and will never be added to your online account. If the incentive is not accepted within 90 days of internal date of record of sending the incentive, the payment shall be forfeited. Focus Forward is not responsible for delays in reporting an incentive you do not receive or your failure to receive any cash payment.

10. PRIVACY

Focus Forward has a firm commitment to safeguarding your privacy. Please review Focus Forward’s and FF Focus Group’s Privacy Policy by clicking on the link at the bottom of this page BEFORE you accept this TOU. You hereby acknowledge and agree that the terms of our Privacy Policy are incorporated into and are part of this TOU and that by accepting this TOU, you are also accepting the Privacy Policy.

11. THIRD PARTY CONTENT AND LINKS

You agree that Focus Forward is not responsible and will not be held liable for any third party content on this Site or any third-party content, products or services available on another web site through a link from this Site. Links to third-party sites are for your convenience only, and their inclusion on this Site does not imply any endorsement, guarantee, warranty or representation by Focus Forward and FF Focus Group.

12. LEGAL DISCLAIMER

This Site operates “AS-IS” and “AS-AVAILABLE,” without liability of any kind. We are not responsible for and disclaim all liability for any events beyond our direct control.

13. PROPRIETARY RIGHTS

This Site and all materials on the Site, including, without limitation, all databases, survey forms, graphics, trademarks and logos on the Site, are protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as specifically permitted in this TOU or by express written consent of Focus Forward, you agree that you shall not use the Site or the material on the Site in any manner.

14. GENERAL TERMS

Focus Forward’s and/or FF Focus Group’s failure to enforce any right or provision in this TOU shall not constitute a waiver of such right or provision or of any other rights or provisions in this TOU. If a court should find that one or more rights or provisions set forth in this TOU are invalid, you agree that the remainder of this Agreement shall be enforceable and that the invalid provision shall be enforceable to the fullest extent permitted by law.
